The Attorney General of the Republic of Rwanda aggrieved by the decision of the First Instance Division dated 26thNovember 2020 which among other things declared that the Republic of Rwanda’s action of taking over and subsequent sale of the First Respondents mall as illegal and a violation of the Treaty.
It is the Appellant’s contention that the judgment of the First Instance Division was not only biased against the Appellant State but was also null and void for being filed out of the Treaty limit of two months as contained in Article 30(2) of the Treaty.
The Appellant thus prays for the Appeal to be allowed with costs to the Appellant and a reversal of the decision of the First Instance Division.
