Subject matter: Acceptance of the reply to the Reference.
The Applicant is the Attorney General of the Republic of Uganda and the government advisor in legal matters sued on behalf of the respective Government. While the Respondent is a citizen of the Republic of Uganda.
The Applicant claims that, Reference No. 17 of 2019 was filed in the registry of the Directorate of civil litigation in the Attorney General of Uganda’s Chambers on the 27th of August 2019 and that, the file was misplaced and inadvertently placed among files meant for audit, thus did not come to the attention of the Director Civil Litigation in time. Following the nature of the case, the Directorate had to go ahead and seek detailed instructions pertaining to this matter from the Chieftaincy of Military Intelligence.
The Respondent will not suffer any prejudice by the orders sought by the Applicant. That, it is just and equitable that this court validate the response to the Reference and that, mistake of the advocate should not be visited on the Applicant. Costs of the Application be in the cause.
