Subject Matter: Interim Injunction.
The Application is based on grounds that it is extremely urgent and if this honorable court does not intervene and halt the Respondent from proceeding with the ongoing recruitment process his conduct would not only amount to dishonoring of the Council of Ministers for the East African Community but would also render Reference No. 16 of 2022 which is pending before this court nugatory.
The Applicant alleges that the Respondent had shortlisted and scheduled the dates for interviewing the candidates for the positions of Hansards Reporter, Hansards Editor and Senior Clerk Assistant in defiance of the Council directive EAC/CM 41/Directive 51), EAC/CM 41/ Directive 52) and EAC/CM 41, Directive 53 of its 41st ordinary meeting.
The Applicant seeks orders:
- that the Court issues an ex-parte injuctions against the Respondent, directing him to halt the ongoing shortlisting and anticipated interviews of candidates shortlisted.
- for an order that costs of and incidental to this application abide the result of the case.
