Summary | This is an Application by Francis Ngaruko (‘the Applicant’) for interim orders against the Attorney General of the Republic of Burundi (‘the Respondent’) pursuant to Article 39 of the Treaty for the Establishment of the East African Community (‘the Treaty) and Rule 21 (2) of this Court’s Rules of Procedure.
The Applicant is a natural person resident in the Republic of Burundi, the son and beneficiary of the Estate of Evariste Sebatutsi (deceased) and a shareholder of property at the heart of this dispute. He lays claim to part of his deceased father’s land that is registered as Reg. File E.XXXVI folio 129 of 28/8/1972, as well as an additional
10 acres of land adjacent to it that he personally acquired (‘the Suit Premises’).
