Subject Matter: Production of a detained person
The Application is grounded on the fact that the subject in the matter Mr Morris Manior Awijok Bak who was arbitrarily arrested by agents of the 1st and 2nd Respondents in Nairobi-Kenya and deported to Juba, South Sudan, has continued to be arbitrarily detained incommunicado in places known to the 1st Respondent and will suffer irreparable injury that can not be compensated by damages and irreparable injustice if the interim orders sought by the Applicant are not granted.
The Applicant seeks orders that:
- the application be certified urgent.
- the Respondents provide information of the whereabouts of the subject.
- the Respondents allow access to him by his family friends, associates, legal counsel and doctors.
- the Respondents provide reasons for his arrest and continued detention; and
- Morris Manior Awijok Bak is released arraigned before a competent, impartial and effective Court or Tribunal.
