Subject matter: Recruitment dispute.  

The Applicant, Prof. Elias Bizuru is a Burundian Citizen, residing in Kigali, Rwanda. He challenges the decision of the IUCEA Executive Committee dated 27th August 2017 which did not appoint him to the position of Chief Research and Innovation Coordination Officer that he had applied. The Applicant alleges that, such a decision is an infringement of Article 6(d) of the Treaty Establishing the East African Community (EAC) and seeks its nullification and costs associated to the Reference.

The Respondent, the Inter-University Council of East Africa is an institution of the EAC sued on its own behalf. The Respondent alleges to have acted in conformity with the relevant provisions of the Treaty, the IUCEA staff rules and regulations, the relevant decisions of the Council of Ministers relating to due diligence from the advertisement stage, interview until the final decision communicated to the Applicant.    

On 5th July 2019, the First Instance Division issued a provisional restraining order against the Respondent from pursing any recruitment of the position of Chief Research and Innovation Coordination Officer until final determination of this Reference.
