Summary

The Applicants allege that during the period immediately preceding, during and after the nomination and subsequent election of H.E. President Pierre NKURUNZIZA (hereinafter the President) for a 3rd term in 2015 (hereinafter 3rd term), many Civil Society Organisations (hereinafter CSOs), Journalists and Human rights activists unsuccessfully tried to engage the President, on the issue of the unconstitutionality and illegitimacy of his 3rd term and the CSOs, Journalists and Human rights activists were met with resistance and repeated systematic reprisals at the hands of Agents of the Government of Burundi.

The Applicants allege that the systematic attacks are a clear and deliberate attack on their freedom of expression and freedom of assembly. That on the basis of the reprisals, the Applicants herein have filed the instant Reference, inter alia on the basis that the Respondent has violated the Applicants’ right to a fair trial, right to a fair hearing, fair administrative action, presumption of innocence, right to enjoy and dispose of one’s property, and freedom of expression.
