REFERENCE NO. 36 OF 2025 ERAJA AGRO INPUT SUPPLIERS LTD v. THE ATTORNEY GENERAL OF THE UNITED REPUBLIC OF TANZANIA

The Applicant alleges that the Respondent’s actions on 20 February 2025 and 27 June 2025 of authorizing the Tanzania Revenue Authority to auction two containers of Jute hessian cloth which had previously been certified as failing to meet quality standards by the Tanzania Bureau of Standards instead of allowing for their re-export or destruction as requested and provided for by law, are unlawful infringements on Articles 6(d) and 7(2) of The Treaty for Establishment of The East African Community as well as the fundamental and operational principles of the Community (specifically the rule of law, transparency, and accountability), the East African Community Customs Management Act 2004, and the East African Community Standardization, Quality Assurance, Metrology and Testing (SQMT) Act of 2006. The Applicant specifically contends that these actions were illegal and malicious, causing a financial loss of USD 10,125,000 and damaging its professional reputation as a regional supplier
