REFERENCE NO. 37 OF 2023 WANI SANTINO JADA v. THE ATTORNEY GENERAL OF THE REPUBLIC OF SOUTH SUDAN

The Applicant alleges that the Respondent’s State Parliament’s decision granting the President powers to appoint five percent 5% of three hundred and thirty-two (332) members of parliament of the National Legislative Assembly under Section 60(4) of the said National Election Act 2012 (Amendment) Act, 2023 was ultra-virus and therefore violates democratic values, rule of law, human rights and hence infringes Articles 6(d) and 7(2) of the Treaty for the Establishment of the East African Community.
