REFERENCE NO. 38 OF 2025 OSIEMO EMILY v. THE ATTORNEY GENERAL OF THE REPUBLIC OF RWANDA

The Applicant alleges that the Respondent’s actions on 26 June 2025 and 10 July 2025 of denying her authorization to offer legal services in Rwanda specifically barring her from representing her client, Victoire Ingabire on the basis of a lack of reciprocity between Kenya and Rwanda, are unlawful infringements on Articles 5(2), 6(d), 7(2), 8(1)(c), and 76 of The Treaty for Establishment of The East African Community.  The Applicant contends these actions violate Articles 5(2)(e), 16, and 17 of the EAC Common Market Protocol and the Schedule of Commitments on the Progressive Liberalization of Services (Annex V), as well as the fundamental and operational principles of the Community regarding the rule of law and the free movement of services.
