Summary

The Applicant alleges that the Respondent’s actions on 9 July 2025 of delivering an adverse Ruling in Homabay ELC NO. E005 of 2023, which set aside a previous Consent Judgment dated 25 October 2023, are unlawful infringements on Articles 6(d) and 7(2) of The Treaty for Establishment of The East African Community as well as the Bangalore Principles of Judicial Conduct, the Rules of Natural Justice, and various provisions of the Constitution of Kenya 2010.
