REFERENCE NO. 43 OF 2025 PETER ODIWUOR NGOGE T/A O. P. NGOGE & ASSOCIATES ADVOCATES v. THE ATTORNEY GENERAL OF THE REPUBLIC OF KENYA

The Applicant alleges that the Respondent’s actions specifically the judgment rendered by the Court of Appeal in Nairobi on 19 September 2025 in Civil Appeal No. 150 of 2019, which dismissed the Applicant’s appeal—are unlawful infringements on Articles 6(d) and 7(2) of The Treaty for Establishment of The East African Community, as well as the Bangalore Principles of Judicial Conduct and the United Nations Basic Principles on the Role of Lawyers. The Applicant specifically contends that by inordinately delaying the determination of the appeal for six years, misrepresenting facts, and permitting the opposing parties to defend claims based on a “purported” Statement of Defence for which no filing fees were paid, the Respondent has failed to uphold the rule of law, fair hearing, and access to justice.
