Summary

The Applicant alleges a breach of contract by the South Sudan Traffic Police (an institution of the Respondent) upon being sub-contracted by Jungo Import and Export Co. Ltd to procure 47,000 three-digit number plates. The conduct followed a participation agreement followed by a financial agreement entered by Jungo Trading with other companies including the 1st Applicant when it failed to provide the needed number plates due to lack of funds; the 1st Applicant paid 60% towards the project. The Respondent failed to fulfil their end bargain of paying the Applicant sums due hence signaling a failure of prompt justice to trading persons from the Republic of South Sudan, another partner state as well as the Attorney General of South Sudan vicariously. The breach of this trading contract by the Respondent was a violation to the Treaty establishing the East African Community under Articles 6 (d) & 7 (2), 27 (2) and 151 together with Articles 2 (1) (3), (3) and 54 (2) (b) of the Protocol on the establishment of the East African Common Market.
