The Applicants allege that on or about the 6th day of February 2020, the First Respondent without due regard to provisions of the East African Community Treaty and the Protocols for the Establishment of the Customs Union and Common Market to which it is a party, entered into, negotiated and/or expressed intention to negotiate a bilateral Free Trade Agreement with the United States of America in total violation of the Treat and the Protocols. That the Second Respondent has failed to warn and/or stop the First Respondents from the acts and that he has failed and/or neglected to take any action since the said violation took place.
