REFERENCE NO. 6 OF 2025 RWAKARENGWA JEAN v. THE ATTORNEY GENERAL REPUBLIC OF RWANDA

The Applicant states that the failure by the judiciary in Respondent’s State to nullify the auction and the decision in the Nyambege lower court occasioned a miscarriage of justice and therefore violated not only the laws in the Republic of Rwanda but also violated the fundamental and operational principles in Article 6(d) and 7(2) of the Treaty. They allege that failure of the supreme court to stop the lower court’s ruling allows for double Jeopardy prohibited under Rule 46 of the 2004 Gacaca Law and a violation of the right to be heard.
