The Applicant alleges that it is a legal assignee of deposits made at Imperial Bank Ltd (Kenya) and has lost its deposits due to failures by the 1st and 2nd Respondents in their duties to govern a bank in accordance with good governance principles thus infringing Articles 6, 7, 8(1), 82(1) and Articles 3 and 14 of the Protocol Establishing the East African Community Monetary Union
