East African Court of Justice, 1st March 2023: The President of the EACJ, Hon. Justice Nestor Kayobera officiated the Special Arbitration Training of Judges of the East African Court of Justice, which was organised in collaboration with the Chartered Institute of Arbitrators (CIArb) – Kenya Branch.
Hon. Justice Kayobera in his opening remarks thanked the Chairperson of the Institute Dr. Willy Mutubwa for the continued collaboration between the two Institutions, which has greatly contributed to building the capacity of the EACJ Judges in the adjudication of Arbitration matters. He noted that the Court is now seeing an increased number of matters being filed for arbitration which is not only a demonstration of the growing confidence in the Court but also an indication of the growing need for the settlement of cross-border disputes through arbitration. This training he said is very necessary for the Judges to enhance their knowledge of the practice and procedure of the arbitral process.
In his remarks, Dr. Wilfred Mutubwa the Chairperson of the Chartered Institute of Arbitrators- Kenya Branch briefed the Judges on the Training programme. He underscored that the training will equip them with the necessary knowledge on existing arbitration best practices and the skills of effectively and efficiently managing arbitral proceedings from initial stage of appointment as dispute resolvers, through identifying issues and analysing evidence. He further highlighted that the training will upgrade the Judges’ global status initially from Associate to Member level and eventually a final training program will be held later in the year to get them to Fellow status. Finally, Dr. Mutubwa thanked the EACJ for its continued trust in the Kenya branch of the Chartered Institute of Arbitrators and wished the Judges the best in their training.
The Training Programme will run for Four (days) from 1st – 4th March 2023 in Moshi, Tanzania and shall be conducted in two segments. The first two days shall include theoretical training and this shall be followed by two days of oral and written assessments. A total of Eight (8) Judges shall undertake this training.
