INTRODUCTION

The jurisprudence of the East African Court of Justice has developed steadily during the last twenty years to cover diverse subject-areas such as: rule of law; good governance; cross-border trade; the responsibilities of States and the Community for internationally wrongful acts or omissions of their organs; and the reparations that can ensue for breaches of the Treaty for the Establishment of the East African Community, the Custom Union and Common Market Protocols and Community Laws.

The objective of the East African Court of Justice Law Reports [EACJLR] 2005 -2011, 2012-2015 and 2015-2017 is to make the Court’s decisions accessible in an easy to read format that includes a summary; key findings; authorities cited; relevant legal instruments; plus the full text of the ruling or judgment. Some of the inaugural cases heard and determined virtually via video conference have also been reported. However, the reports do not contain all cases that the Court has determined since its inception.

The Court disclaims responsibility for any errors, omissions or discrepancies contained in these reports. Only the original signed and stamped decision held in the Court’s Registry is the authentic version and will prevail.
