Subject matter: Recruitment dispute.

The Appellant being dissatisfied with the decision of the First Instance Division dated 28th September 2020 in Reference No. 13 of 2017 Prof. Elias Bizuru vs Inter-University Council of East Africa, appealed to the Appellate Division against the whole decision on grounds that: the First Instance Division erred in law and facts in holding the decision in favour of the Respondent who refused to appoint the Appellant upon emerging as the best candidate in the interview for the position of the Chief Research and Innovation Officer of the Inter University Council of East Africa (IUCEA) and ruling that, such decision was not an infringement of transparency and good governance in the recruitment process as provided under Article 6(d) of the Treaty for the Establishment of the East African Community.

Further, the First Instance Division erred in awarding costs of the suit to the Respondent who is the sole cause of the litigation.

The Appellant prays for declarations that, the decision of Inter-University Council of East Africa dated 27th August 2012 infringes on the EAC Treaty, nullification of the same and an order be issued on appointment of the Appellant (Prof. Bizuru Elias) to the position of Chief Research and Innovation Officer, damages be awarded to the Appellant and costs.
