The Application arises from the liquidation order by the Commercial Court of the Republic of Rwanda of a company registered in the Republic of Rwanda known as Union Trade Centre (UTC) in December 2020.

The main contention of the application is that the two advocates representing the company in the East Africa Court of Justice are strangers to the company and are illegally doing so. The applicant contends that according to Rwandan law no proceedings, execution or other legal process may be commenced or continued against the company or its property except with the liquidators consent or with an order of the Court.

The Respondent (UTC) argue that the two advocates representing the company in Court were dully appointed by the majority shareholder and have proper powers to do so.
