The Applicant alleges the Respondent’s failure to pay for the supplies of different types of food items, fuel products, cash payments and the use of the Applicant’s aircraft by the Respondent’s government amounting to the sums of USD 764, 542, 245.00, Euro 9,332254.00 and South Sudan Pounds (SSP) 105, 744, 142.00 violate Articles 5(3)(g), 6(d), 7(2), 8(1)(a) (b) and (c), (4) of the Treaty for the Establishment of the East African Community and Articles 2(1)(3), 3(1), 54 of the Protocol on the Establishment of the East African Community Common Market.
