The Applicant alleges that the Respondent’s State action and decision through Director General of the National Communication Authority (NCA) and the Media Authority of issuing licenses for the operation of a commercial radio 87.6 FM station in secrecy and irregularity without the landowner’s consent therefore appropriating the Applicant’s land hence infringing upon the Transitional Constitution of South Sudan and the African Charter on Human and People’s Rights infringed upon Article 6(d), 7(2), 8(1)(c), 23(1), 27(1) and 30(1) & (2) of the Treaty for the Establishment of the East African Community.
