REFERENCE NO. 37 OF 2020 AMOS OPUDO AKECH v. EAST AFRICAN DEVELOPMENT BANK (EADB) & 2 OTHERS

The applicant alleges that the 3rd Respondent, under the instruction from, and/or agreement with the 1st and 2nd Respondents, after frustrating the applicant’s efforts to get his pension close to 3 years only paid USD 21,372.49 to his account instead of the full pension amounting to USD 46,639.14. Thus, denying the Applicant some 25,266.65 constituting the employer’s contribution which was rightfully due to the Applicant, infringing Articles 6(d), 9(3) and (4), 30 and 33 of the Treaty establishing the East African Community; and Rules 4, 25 (1), (2) and (3) of the East African Court of Justice Rules of Procedure 2019.
