REFERENCE NO. 56 OF 2022 MARTHA WANGARI KARUA & ANOTHER V. THE ATTORNEY GENERAL OF THE REPUBLIC OF KENYA

The Applicant alleges that the Respondent’s State action by its Independent Electoral and Boundaries Commission of Kenya (IEBC) of conducting the presidential elections and declaring the winner in violation of the of the Constitution and laws of Kenya and the act of the Respondent’s State Supreme Court presidential dispute resolution process failing to properly adjudicate resultant dispute in accordance with the Constitution and laws of Kenya as well as applicable AU Treaty Law, International Law, the principles governing elections and electoral dispute resolution were all violations of Article 6(d), 7(1)(b) and 8(1)(c) of the EAC Treaty.
