REFERENCE NO. 37 OF 2022 MAGWERI MOKINGA MAKO & 5 OTHERS v. THE ATTORNEY GENERAL OF THE UNITED REPUBLIC OF TANZANIA

The Applicant’s alleges that the Wildlife Conservation (Pololeti Game Control Area) (Declaration) Order 2022 made by the Minister of Natural Resource and Tourism of the Respondent State illegally declaring land measuring 1502 square as Pololeti Game Controlled Area, which land has been used by the Applicants and their community as ancestral territory where they have practiced pastoralism and spiritual practices is an infringement of Articles 6(d), 7(2) and 8(1) (c) of the Treaty for the Establishment of the East African Community.
