REFERENCE NO. 31 OF 2025 KALALI STEVEN v. THE ATTORNEY GENERAL OF THE UNITED REPUBLIC OF TANZANIA

The Applicant alleges that the Respondent’s actions on 25 July 2025 of enacting and publishing the Business Licensing (Prohibition of Business Activities for Non-Citizens) Order, 2025, which prohibits non-citizens (including citizens of EAC Partner States) from engaging in 15 specific business sectors and criminalizes such participation with fines and imprisonment, are unlawful infringements on Articles 6(b) and (d), 7(1)(a) and (2), and 8(1)(c) of The Treaty for Establishment of The East African Community as well as the Fundamental and Operational Principles of the Community, the Common Market Protocol, and the right of establishment.
