Arusha, 2 May 2013: The First Instance Division of EACJ today dismissed an Application by the Secretary General to have the Claim filed by Angella Amudo declared as time barred for its being misguided and misconceived. Before the commencement of the hearing of the Claim which was also slated for the same day today after delivery of the ruling, Mr. Steven Agaba Counsel for the Secretary General the Respondent in the Claim made an oral application in the interest of justice to have the proceedings stayed pending an appeal which he intends to file against the earlier ruling dismissing his application and that costs abide the outcome of the Claim. Mr. Nangwala for the Applicant opposed the application and argued that the matter should proceed for hearing and that the Respondent will not be prejudiced if the claim proceeds for hearing. The court stayed proceedings in the claim pending the appeal and ordered that the Secretary General files his appeal in accordance with the Courts Rules of Procedure.

Ms. Angela Amudo, a former Project accountant at the EAC alleges that she was employed as a professional staff accountant and was therefore entitled to a five year contract renewable once under the EAC Staff Rules and Regulations, but says the SG illegally caused her to sign a contract for twenty two months instead of the five years and has thus sought the Court’s intervention.
